I. General Terms and Conditions
§ 1 General Provisions
(1) The following Terms and Conditions apply to contracts that you enter into with us, the provider (P4P Solutions GmbH), via the website www.massagesesselwelt.de. Unless otherwise agreed, we do not accept the inclusion of any terms and conditions you may use.
(2) For the purposes of the provisions below, a “consumer” is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity. A “business operator” is any natural or legal person, or a partnership with legal capacity, that acts in the course of its independent professional or commercial activity when entering into a legal transaction.
§ 2 Formation of the Contract
(1) The subject matter of this contract is the sale of goods and/or the provision of repair services and/or the provision of installation services.
(2) By listing the respective product on our website, we are making you a binding offer to enter into a contract via the online shopping cart system under the terms specified in the product description.
(3)The contract is concluded via the online shopping cart system as follows:
The goods and/or repair services you intend to purchase are added to the "Shopping Cart." You can access the "Shopping Cart" by clicking the corresponding button in the navigation bar and make changes there at any time.
After clicking the “Checkout” or “Proceed to Order” button (or similar term) After entering your personal information and selecting your payment and shipping options, you will see an order summary displaying your order details.
If you choose an instant payment system (e.g., PayPal (Express/Plus/Checkout), Amazon Pay, Sofort, giropay) as your payment method, you will either be directed to the order summary page in our online store or redirected to the website of the instant payment system provider.
If you are redirected to the respective instant payment system, make the appropriate selections or enter your information there. Finally, your order details will be displayed as an order summary on the instant payment system provider’s website or after you have been redirected back to our online store.
Before submitting your order, you have the option to review the details in the order summary, make changes (including by using your web browser's "Back" button), or cancel the order.
(4) Your requests for a quote are nonbinding. We will provide you with a binding quote in writing (e.g., via email), which you may accept within 5 days (unless a different deadline is specified in the quote).
(5) The processing of the order and the transmission of all information required in connection with the conclusion of the contract are carried out in part automatically via email. You must therefore ensure that the email address you have provided to us is correct, that receipt of the emails is technically guaranteed, and, in particular, that they are not blocked by spam filters.
§ 3 Custom-Designed Goods
(1) You must provide us with the appropriate information, text, or files required for the customization of the goods via the online ordering system or by email no later than immediately after the contract is concluded. Any specifications we provide regarding file formats must be followed.
(2) You agree not to transmit any data whose content infringes the rights of third parties (in particular copyrights, rights to a name, and trademark rights) or violates applicable laws. You expressly indemnify us against all claims asserted by third parties in this connection. This also applies to the costs of any legal representation required in this connection.
(3) We do not verify the accuracy of the content of the data submitted and assume no liability for errors in this regard.
(4) Unless otherwise specified in the respective offer, you will receive We will send you a proof, which you must review immediately. If you agree with the draft, please approve the proof for production by countersigning it in writing (e.g., via email).
We will not proceed with the design work without your approval.
You are responsible for verifying that the proof is accurate and complete and for notifying us of any errors. We assume no liability for errors that have not been reported.
§ 5 Provision of Services for Repairs
(1) To the extent that repair services are the subject matter of the contract, we are obligated to perform the repair work specified in the service description. We shall perform these services to the best of our knowledge and belief, either personally or through third parties.
(2) You are obligated to cooperate; in particular, you must describe the defect in the device as comprehensively as possible and make the defective device available to us.
(3) You are responsible for the costs of shipping the defective device to us.
(4) Unless otherwise specified in the respective quote, the repair—including preparation of the device for shipment—will be completed within 5–7 days of receipt of the device to be repaired (however, in the case of agreed-upon prepayment, only after we have received your payment instruction).
(5) If you exercise your right to terminate the contract pursuant to Section 648, sentence 1 of the German Civil Code (BGB), we may demand a flat-rate fee of 10% of the agreed-upon fee if performance has not yet begun. However, where a statutory right of withdrawal applies, this applies only if you exercise your right to terminate the contract after the withdrawal period has expired. You reserve the right to prove that we in fact incurred no costs or significantly lower costs.
§ 6 Term of the Contract / Termination of Subscription Contracts
The extended contractual relationship may be terminated at any time with one month's notice (unless a shorter notice period is specified in the respective offer).
(3) The right to terminate the contract without notice for good cause remains unaffected by this provision.
(4) Any cancellation must be submitted either in writing (e.g., via email) or by using the cancellation button provided on our website (“Cancel Contracts Here” or a similar label).
§ 7 Special Provisions Regarding Offered Payment Methods
In cooperation with the payment service provider Klarna Bank AB (publ) (Sveavägen 46, 111 34 Stockholm, Sweden; “Klarna”), we offer the following payment options. Payment is made to Klarna in each case:

(3) SEPA Direct Debit
When paying by SEPA Direct Debit, you authorize us—by issuing a corresponding SEPA mandate—to collect the invoice amount from the specified account.
The direct debit will be processed within 10–15 days after the contract is signed.
The deadline for submitting the pre-notification is reduced to 5 days before the due date. You are required to ensure that there are sufficient funds in the account on the due date. In the event of a chargeback due to your fault, you are responsible for paying the applicable bank fee.
(4) Payment via "PayPal" / "PayPal Checkout"
If you select a payment method offered via "PayPal" / "PayPal Checkout," the payment will be processed by the payment service provider PayPal (Europe) S.à.r.l. et Cie, S.C.A. (22-24 Boulevard Royal L-2449, Luxembourg; "PayPal"). The individual payment methods available through "PayPal" are displayed under a corresponding button on our website as well as during the online ordering process. "PayPal" may use additional payment services to process payments; if special payment terms apply in this regard, you will be notified of them separately. (5) Payment via "Stripe"
If you select a payment method offered through "Stripe," payment processing is handled by the payment service provider Stripe Payments Europe Limited (1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland; "Stripe"). The individual payment methods available through “Stripe” are displayed under a corresponding button on our website and during the online ordering process. “Stripe” may use additional payment services to process payments; if special payment terms apply in this regard, you will be notified of them separately. § 8 Right of Retention, Retention of Title
(1) You may exercise a right of retention only to the extent that the claims arise from the same contractual relationship.
(2) The goods remain our property until the purchase price has been paid in full.
(3)If you are a business entity, the following provisions apply in addition:
a) We reserve title to the goods until all claims arising from the ongoing business relationship have been settled in full. Pledging or transfer of ownership by way of security is not permitted prior to the transfer of title to the goods subject to retention of title.
b) You may resell the goods in the ordinary course of business. In this case, you hereby assign to us all claims in the amount of the invoice total arising from the resale; we accept this assignment. You remain authorized to collect the claim. However, if you fail to properly meet your payment obligations, we reserve the right to collect the claim ourselves.
c) In the event of combination or mixing of the goods subject to retention of title, we shall acquire co-ownership of the new item in the ratio of the invoice value of the goods subject to retention of title to the other processed items at the time of processing.
d) We undertake to release the security to which we are entitled at your request to the extent that the realizable value of our security exceeds the claim to be secured by more than 10%. The selection of the security to be released is at our discretion.
§ 9 Warranty
(1) The statutory rights regarding liability for defects apply.
(2) Provided thatwe notify you of this prior to your submission of the contract declaration and this has been expressly and separately agreed upon, the statute of limitations for claims for defects in used goods is one year from the date of delivery of the goods. The foregoing limitation does not apply:
(4) If a characteristic of the goods deviates from the objective requirements, such deviation shall be deemed agreed upon only if you were notified of it by us prior to our submission of the contractual declaration and the deviation was expressly and separately agreed upon between the contracting parties.
(5) If you are a business, the following provisions apply in deviation from the warranty provisions above:
a) Only our own specifications and the manufacturer’s product description shall be deemed agreed uponasthe quality of the goods; other advertising, public promotions, and statements by the manufacturer shall not be considered.
b) In the event of defects, we shall, at our discretion, provide warranty by repair or replacement. If the attempt to remedy the defect fails, you may, at your discretion, demand a price reduction or withdraw from the contract. The attempt to remedy the defect shall be deemed to have failed after a second unsuccessful attempt, unless the nature of the goods, the defect, or other circumstances indicate otherwise. In the event of repair, we are not required to bear the additional costs incurred by transporting the goods to a location other than the place of performance, provided that such transport does not correspond to the intended use of the goods.
c) Thewarranty period is one year from delivery of the goods. The reduction of the warranty period does not apply:
- for damages attributable to us that result from injury to life, body, or health, and for other damages caused intentionally or through gross negligence;
- if we have fraudulently concealed the defect or have provided a warranty regarding the quality of the item;
- in the case of items that have been used in a structure in accordance with their normal intended use and have caused the structure’s defectiveness;
- in the case of statutory recourse claims that you have against us in connection with your rights regarding defects.
§ 10 Choice of Law, Place of Performance, Jurisdiction
(1)German law shall apply. With respect to consumers, this choice of law shall apply only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has his or her habitual residence (principle of favorability).
(2)The place of performance for all obligations arising from business relationships with us, as well as the venue for legal proceedings, is our registered office, provided that you are not a consumer but rather a merchant, a legal entity under public law, or a special fund under public law. The same applies if you do not have a general venue for legal proceedings in Germany or the EU, or if your domicile or habitual residence is unknown at the time the action is filed. The right to bring an action before a court at another statutory place of jurisdiction remains unaffected by this provision.
(3)The provisions of the United Nations Convention on Contracts for the International Sale of Goods are expressly excluded.

(2) Services will be provided on the agreed-upon dates.
(3) You are obligated to cooperate. In particular, at the time the installation services are provided, you must ensure that the premises are accessible and in a reasonably safe condition. Furthermore, you are obligated to provide us with electricity and, if necessary, water. We are entitled to terminate the portion of the contract relating to the provision of installation services pursuant to § 643 of the German Civil Code (BGB) if you fail to fulfill your obligations to cooperate. To this end, we will set a reasonable deadline for you to fulfill the necessary obligations to cooperate.
(4) If you exercise your right to terminate the contract pursuant to § 648, sentence 1 of the German Civil Code (BGB), we may demand a flat-rate fee of 10% of the agreed-upon fee if performance has not yet begun. (1) The subscription agreement entered into between you and us has the term specified in the respective offer, hereinafter referred to as the “basic term.” A basic term of more than 2 years cannot be agreed upon.
(2) Unless the subscription agreement is terminated by either party one month before the end of the initial term (unless a shorter notice period is specified in the respective offer), it is automatically extended for an indefinite period.
The extended contractual relationship may be terminated at any time with one month's notice (unless a shorter notice period is specified in the respective offer).
(4) Any cancellation must be submitted either in writing (e.g., via email) or by using the cancellation button provided on our website (“Cancel Contracts Here” or a similar label).
§ 7 Special Provisions Regarding Offered Payment Methods

If you select the “Sofort / Sofortüberweisung” payment method, payment processing is handled by the payment service provider Sofort GmbH (Theresienhöhe 12, 80339 Munich, Germany; “SOFORT”). § 8 Right of Retention, Retention of Title
(1) You may exercise a right of retention only to the extent that the claims arise from the same contractual relationship.
(2) The goods remain our property until the purchase price has been paid in full.
(3)If you are a business entity, the following provisions apply in addition:
a) We reserve title to the goods until all claims arising from the ongoing business relationship have been settled in full. Pledging or transfer of ownership by way of security is not permitted prior to the transfer of title to the goods subject to retention of title.
b) You may resell the goods in the ordinary course of business. In this case, you hereby assign to us all claims in the amount of the invoice total arising from the resale; we accept this assignment. You remain authorized to collect the claim. However, if you fail to properly meet your payment obligations, we reserve the right to collect the claim ourselves.
c) In the event of combination or mixing of the goods subject to retention of title, we shall acquire co-ownership of the new item in the ratio of the invoice value of the goods subject to retention of title to the other processed items at the time of processing.
d) We undertake to release the security to which we are entitled at your request to the extent that the realizable value of our security exceeds the claim to be secured by more than 10%. The selection of the security to be released is at our discretion.
§ 9 Warranty
(1) The statutory rights regarding liability for defects apply.
(2) Provided thatwe notify you of this prior to your submission of the contract declaration and this has been expressly and separately agreed upon, the statute of limitations for claims for defects in used goods is one year from the date of delivery of the goods. The foregoing limitation does not apply:
- for damages attributable to us that result from injury to life, body, or health, and for other damages caused intentionally or through gross negligence;
- if we have fraudulently concealed the defect or have provided a warranty regarding the quality of the goods.
(3) As a consumer, you are asked to inspect the goods immediately upon delivery to ensure they are complete and free of obvious defects or shipping damage, and to notify us and the carrier of any issues as soon as possible. Failure to do so will not affect your statutory warranty rights.(4) If a characteristic of the goods deviates from the objective requirements, such deviation shall be deemed agreed upon only if you were notified of it by us prior to our submission of the contractual declaration and the deviation was expressly and separately agreed upon between the contracting parties.
(5) If you are a business, the following provisions apply in deviation from the warranty provisions above:
a) Only our own specifications and the manufacturer’s product description shall be deemed agreed uponasthe quality of the goods; other advertising, public promotions, and statements by the manufacturer shall not be considered.
b) In the event of defects, we shall, at our discretion, provide warranty by repair or replacement. If the attempt to remedy the defect fails, you may, at your discretion, demand a price reduction or withdraw from the contract. The attempt to remedy the defect shall be deemed to have failed after a second unsuccessful attempt, unless the nature of the goods, the defect, or other circumstances indicate otherwise. In the event of repair, we are not required to bear the additional costs incurred by transporting the goods to a location other than the place of performance, provided that such transport does not correspond to the intended use of the goods.
c) Thewarranty period is one year from delivery of the goods. The reduction of the warranty period does not apply:
- for damages attributable to us that result from injury to life, body, or health, and for other damages caused intentionally or through gross negligence;
- if we have fraudulently concealed the defect or have provided a warranty regarding the quality of the item;
- in the case of items that have been used in a structure in accordance with their normal intended use and have caused the structure’s defectiveness;
- in the case of statutory recourse claims that you have against us in connection with your rights regarding defects.
§ 10 Choice of Law, Place of Performance, Jurisdiction
(1)German law shall apply. With respect to consumers, this choice of law shall apply only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has his or her habitual residence (principle of favorability).
(2)The place of performance for all obligations arising from business relationships with us, as well as the venue for legal proceedings, is our registered office, provided that you are not a consumer but rather a merchant, a legal entity under public law, or a special fund under public law. The same applies if you do not have a general venue for legal proceedings in Germany or the EU, or if your domicile or habitual residence is unknown at the time the action is filed. The right to bring an action before a court at another statutory place of jurisdiction remains unaffected by this provision.
(3)The provisions of the United Nations Convention on Contracts for the International Sale of Goods are expressly excluded.
